Solvency II Group Supervision: An Introduction to the Legal and Economic Background

This chapter provides a structured introduction to Solvency II group supervision by combining legal and economic perspectives. It begins by outlining the rationale for group-specific oversight, highlighting prudential risks such as contagion, double gearing, and intra group transactions. The subsequent legal analysis follows the three pillar architecture of Solvency II, explaining the scope of application, quantitative capital requirements, governance and risk management obligations, and reporting duties at group level. Particular attention is paid to the supervisory architecture, including the role of the group supervisor and the functioning of colleges of supervisors. The chapter then turns to the economic significance of insurance groups, draw-ing on empirical data to demonstrate their market relevance and solvency strength. Throughout, key amendments introduced by the Solvency II Review are integrated, especially regarding the expanded scope of group supervision, strengthened governance requirements, and the introduction of macroprudential and sustainability-related elements. The chapter concludes with a critical assessment and an outlook.

This article deals with the digitalization of management accounting / controlling in insurance companies, which goes hand in hand with the digital transformation of the insurance industry by Big Data, Artificial Intelligence (AI) and Blockchain. The insurance business requires an industry-specific design of the controlling instruments, but not of the controlling concept itself. Managing insurance as a service in a value- and risk-oriented way requires cost transparency, e.g. through contribution margin calculations. Risks, on the other hand, can only be understood from a balance sheet perspective, e.g. through internal models. These interdisciplinary fields of application of controlling are undergoing digitalization. In addition, there are new market developments such as telematics tariffs, in which the digitalization of controlling is essential in order to address the limits of insurability. The fields of application result in new competence profiles of controllers in distinction to actuaries and data scientists.

In dem Beitrag werden die Auswirkungen der Umsetzung der Solvency II-Richtlinie in das neue deutsche Versicherungsaufsichtsgesetz (VAG 2016) auf den Treuhänder des Sicherungsvermögens untersucht. Der Treuhänder des Sicherungsvermögens gehört zu den nationalen Sicherungsmechanismen, um Versicherungsnehmer für den Fall der Insolvenz ihres Versicherungsunternehmens zu schützen. Für Solvency II-Versicherungsunternehmen entfiel die bisherige deutsche Anlageverordnung (AnlV) zum 01.01.2016. Statt eines vorgegebenen Anlagekatalogs sind die Versicherungsunternehmen nun verpflichtet, eine interne Anlagerichtlinie zu haben, die auch Grundlage der Überwachung des Sicherungsvermögens durch den Treuhänder ist. Herausforderungen ergeben sich aus der Kollision der Rechnungslegungssicht (HGB) mit der Solvency II-Marktwertsicht. Die Untersuchung leistet damit einen Beitrag zum besseren Verständnis des Zusammenspiels zwischen unveränderten rechtlichen Normen und der neuen ökonomischen, risikobasierten Solvency II-Perspektive.
